Terms Of Service

  1. Introduction and Binding Agreement

These Terms of Service (referred to as the "Terms" or "Agreement") are a legally binding contract between Tactical2020 LTD, a Hong Kong registered company operating as Strike20, with a warehouse at Room 1006, Building B, Niu Hu Community, Junxin Road, Guanlan Street, Longhua District, Shenzhen, China (referred to as "Strike20," "we," "us," or "our"), and you, the individual or entity using the Strike20 website located at www.strike20.com (the "Site"). Strike20 specializes in selling tactical equipment for airsoft, security personnel, and military applications.

By accessing, browsing, or using the Site, you ("User," "you," or "your") confirm that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy and any other policies or agreements referenced here. If you do not agree to these Terms, you must not use the Site.

  1. Definitions

2.1. "Site" refers to the website www.strike20.com and all associated webpages, content, features, and functionality.

2.2. "User" refers to any individual or entity that accesses or uses the Site, whether or not they create an account.

2.3. "Account" refers to a personalized section of the Site created by a User to access certain features and functionalities, including but not limited to order history and saved preferences.

2.4. "Product" refers to any tactical equipment, gear, or related items offered for sale on the Site.

2.5. "Order" refers to a request placed by a User to purchase one or more Products through the Site.

2.6. "Content" refers to any and all text, graphics, images, photographs, videos, audio, software, code, data, or other materials or information available on or through the Site.

  1. Acceptance of Terms

3.1. By accessing or using the Site, you affirm that you are of legal age as per your jurisdiction and possess the legal capacity to enter into this Agreement. If you are under the legal age or lack legal capacity, you may not use the Site without the consent and supervision of a parent or legal guardian.

3.2. You agree to comply with all applicable laws and regulations while using the Site. You further acknowledge that your use of the Site is at your sole risk, and Strike20 shall not be held liable for any damages or losses arising from your use of the Site.

  1. Modification of Terms

4.1. Strike20 reserves the right, at its sole discretion, to modify, alter, or update these Terms at any time, with or without prior notice. Such modifications shall be effective immediately upon posting on the Site. Your continued use of the Site after the posting of any changes constitutes your acceptance of the revised Terms.

4.2. It is your responsibility to review these Terms periodically to ensure that you are aware of any changes. If you do not agree with any modifications to the Terms, you must immediately cease using the Site.

  1. Account Registration and Security

5.1. In order to access certain features of the Site, such as placing orders, you may be required to create an Account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

5.2. You are solely responsible for maintaining the confidentiality of your Account login credentials, including your username and password. You agree not to disclose your login credentials to any third party and to immediately notify Strike20 of any unauthorized use of your Account.

5.3. Strike20 reserves the right to suspend or terminate your Account at any time, for any reason, with or without notice. This includes but is not limited to a breach of these Terms, fraudulent activity, or inactivity for an extended period.

  1. Product Information and Pricing

6.1. Strike20 strives to provide accurate and up-to-date information about the products available on the Site, including descriptions, specifications, pricing, and availability. However, we do not guarantee the accuracy, completeness, reliability, or timeliness of any product information.

6.2. All prices for products listed on the Site are shown in the currency corresponding to the user's location. For local users in Hong Kong, prices are displayed in HKD. For international users, prices are shown in the currency corresponding to their country (USD, GBP, EUR or any other applicable). All prices are exclusive of any applicable taxes, duties, or shipping fees. Strike20 reserves the right to change prices at any time without prior notice. The price displayed at the time of purchase is final.

6.3. Product availability on the Site may be limited and is subject to change without notice. Strike20 is not liable for any unavailability of products or for any errors or omissions in product descriptions or pricing information.

  1. Orders and Payment

7.1. By placing an Order through the Site, you make an offer to purchase the selected Products at the price indicated, subject to these Terms. All Orders are subject to acceptance by Strike20, which may be granted or withheld at our sole discretion. We reserve the right to refuse or cancel any Order, including but not limited to cases of suspected fraud, inaccurate information, or product unavailability.

7.2. We accept a variety of payment methods, as indicated on the Site. All payments must be made in full at the time of Order placement. By submitting your payment information, you represent and warrant that you are authorized to use the chosen payment method and that the information you provide is accurate and complete. You agree to pay all charges incurred in connection with your Order, including the price of the Product(s), applicable taxes, and shipping fees.

  1. Order Acceptance and Confirmation

8.1. Upon placing an Order, you will receive an email acknowledgement from Strike20 confirming receipt of your Order. This acknowledgement does not constitute acceptance of your Order.

8.2. Strike20 reserves the right to accept or decline your Order in whole or in part, at our sole discretion. We may decline your Order for reasons such as product unavailability, errors in pricing or product information, or suspicion of fraudulent activity.

8.3. Upon acceptance of your Order, Strike20 will send you an email confirmation indicating that your Order has been processed and is being prepared for shipment. This confirmation email will serve as our acceptance of your Order and will form a binding contract between you and Strike20.

  1. Order Cancellation and Modification

9.1. You may cancel your Order at any time before it has been shipped by contacting Strike20 customer service. Once an Order has been shipped, it cannot be cancelled.

9.2. Modifications to an Order, such as changes to the shipping address or Product quantity, may be possible before the Order has been shipped, subject to Strike20's approval.

  1. Shipping and Delivery

10.1. Strike20 will ship your Order to the shipping address provided during the checkout process. We offer international shipping to select countries. Please refer to our Shipping Policy for details on shipping methods, estimated delivery times, and applicable fees.

10.2. Risk of loss and title for Products purchased from the Site passes to you upon delivery of the items to the carrier. Strike20 shall not be held liable for any loss, damage, or delay incurred during shipping.

  1. Returns and Refunds

11.1. Strike20 offers a 30-day return and exchange policy for most Products purchased on the Site. To be eligible for a return or exchange, the Product must be unused, in its original packaging, and accompanied by proof of purchase.

11.2. Please refer to our Returns and Refunds Policy for detailed instructions on how to initiate a return or exchange and for information on refund processing times.

  1. Intellectual Property Rights

12.1. The Site and its Content, including but not limited to text, graphics, logos, images, audio, video, software, and code, are the property of Strike20 or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws.

12.2. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content from the Site without the prior written consent of Strike20, except as expressly permitted by these Terms.

  1. User Conduct

13.1. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site. Prohibited conduct includes but is not limited to:

  • Posting or transmitting any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, or indecent information or material.
  • Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
  • Interfering with or disrupting the operation of the Site or the servers or networks connected to the Site.
  • Uploading or transmitting any viruses, worms, Trojan horses, or other harmful or destructive code.
  • Collecting or storing personal data about other Users without their knowledge or consent.

13.2. Strike20 reserves the right to investigate and prosecute any violations of these Terms to the fullest extent of the law. We may involve and cooperate with law enforcement authorities in prosecuting Users who violate these Terms.

  1. User-Generated Content

14.1. The Site may allow you to submit, upload, post, or otherwise make available content, such as reviews, comments, or photos (collectively, "User Content"). By submitting User Content, you grant Strike20 a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.

14.2. You represent and warrant that you own or otherwise control all of the rights to the User Content that you post and that the User Content does not violate these Terms or any applicable laws or regulations.

14.3. Strike20 reserves the right to remove or edit any User Content that we deem to be inappropriate, offensive, or in violation of these Terms.

  1. Third-Party Links and Content

15.1 The Site may contain links to third-party websites, applications, or services that are not owned or controlled by Strike20. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Strike20 shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

  1. 16. Giveaways and Contests

16.1. Strike20 may, from time to time, conduct giveaways and contests. Participation in such events is subject to specific terms and conditions which will be provided at the time of the event.

16.2. By participating in any giveaway or contest, you agree to comply with the official rules and regulations, including eligibility requirements and entry restrictions.

16.3. Strike20 reserves the right to disqualify any participant who violates the rules or engages in fraudulent activity.

16.4. Strike20 is not responsible for any technical issues, including but not limited to lost, interrupted, or unavailable network, server, or other connections, or any other technical problems.

  1. 17. Disclaimer of Warranties

17.1 The Site and all Products are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Strike20 does not warrant that the Site or any Products will be uninterrupted, error-free, virus-free, or secure.

17.2 Strike20 makes nowarranties or representations regarding the use of the Site or the results that may be obtained from the use of the Site or any Products.

  1. 18. Limitation of Liability

18.1 To the maximum extent permitted by applicable law, Strike20 shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Site; (b) any conduct or content of any third party on the Site; (c) any content obtained from the Site; or (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

19.1 You agree to indemnify, defend, and hold harmless Strike20 and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or in connection with (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any rights of a third party, including but not limited to intellectual property rights; or (d) your conduct in connection with the Site.

  1. 20. Governing Law and Dispute Resolution

20.1 These Terms and any dispute or claim arising out of or in connection with these Terms or the Site shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions.

20.2 Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in Hong Kong in accordance with the Hong Kong International Arbitration Centre (HKIAC) Administered Arbitration Rules in force when the Notice of Arbitration is submitted.

21.1 Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and disclose information that we obtain from you through the Site. The Privacy Policy is incorporated into and made a part of these Terms.

  1. 23. Force Majeure

23.1 Neither party shall be liable for any delay or failure to perform its obligations under these Terms if such delay or failure is due to any cause beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

  1. 24. Severability

24.1 If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid, illegal, or unenforceable provision shall be replaced by a valid, legal, and enforceable provision that most closely matches the intent of the original provision.

  1. 25. Entire Agreement

25.1 These Terms constitute the entire agreement between you and Strike20 regarding your use of the Site and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Strike20.

26.1 You may not assign or transfer these Terms or any rights or obligations hereunder, without the prior written consent of Strike20. Strike20 may assign or transfer these Terms or any rights or obligations hereunder, in whole or in part, without restriction.

  1. 27. Waiver

27.1 The failure of either party to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by the party granting the waiver.

  1. 28. Notices

28.1 All notices, requests, demands, and other communications under these Terms shall be in writing and shall be deemed to have been duly given when delivered personally, by email, or by registered or certified mail to the address specified in these Terms or such other address as either party may specify in writing.

  1. 29. Survival

29.1 The provisions of these Terms which by their nature should survive the termination of these Terms shall survive such termination, including, without limitation, Sections 12 (Intellectual Property Rights), 16 (Disclaimer of Warranties), 17 (Limitation of Liability), 18 (Indemnification), 19 (Governing Law and Dispute Resolution), and 20 (Privacy Policy).
